What is Probate? - 24th January 2011

"Probate" is the right to deal with a deceased person's estate and is usually assumed by the person(s) named as Executor(s) in the Will. If there is no known Will, someone close to the deceased may apply to administer the estate, this is known as applying for "Letters of Administration".

Individuals who are granted Probate must administer the Testator's estate in accordance with the terms of the Will as well as deal with any associated matters that may a rise during the period of administration. If there is no Will, the estate must be administered in accordance with the Laws of Succession.
